Dr. Conrad Murray has been formally charged in the death of Michael Jackson, but he’s already out of custody.

E! News reports that Conrad was charged with involuntary manslaughter, a misdemeanor, on Monday. The doctor subsequently pleaded not guilty to the charges.

Hours after he was charged with involuntary manslaughter, Conrad was released on $75,000 bail. However, his ability practice medicine has been curtailed as part of his punishment in that he is not allowed to administer “any heavy sedatives,” especially not propofol.

Many question why Conrad was not charged with murder; in the Los Angeles County District Attorney’s suit it states he “did unlawfully, and without malice, kill Michael Joseph Jackson…in the commission of an unlawful act, not amounting to a felony; and in the commission of a lawful act which might have produced death, in an unlawful manner, and without due caution and circumspection."

Conrad is due back in court on April 5 for a preliminary hearing in the misdemeanor case.
