Kim Kardashian (pictured, right) has filed suit against Old Navy for using a lookalike, who is currently dating her ex, in its ads.
Court papers, which Kim filed at a Los Angeles federal court on Wednesday, indicate that The Gap, Old Navy’s parent company, falsely represented the reality star by using a woman who resembles Kim in their commercials. Kim is requesting compensatory and punitive damages for the ad, which has now received over 2 million views on YouTube.
"[Kim] is among the top celebrities who drive the most consumer traffic to brand advertisers’ websites," the legal documents state. "The infringing ads falsely represent that Kim Kardashian sponsors, endorses or is associated with [Gap Inc.]."
Kim has been known to endorse a few brands including Quick Trim, Carl’s Jr., Sketchers, and most recently her own clothing and shoe line. Her commercial for the brand, titled Super C-U-T-E, began running in February and Kim’s legal team is suggesting that fans may be confused about which brands the “Keeping Up With the Kardashians” star actually endorses.
While the legal argument may be valid, some wonder whether Kim is just hating on the "lookalike" model, Melissa Molinaro (pictured, left), who is currently dating Kim’s ex, Reggie Bush.
The Gap has yet to respond on whether its intent was to air ads featuring someone with Kim’s look.
The lawsuit states that Kim keeps strict control over the use of her image and “has invested substantial time, energy, finances and entrepreneurial effort in developing her considerable professional and commercial achievements and success.” The suit also requests that Old Navy not to use the lookalike in future advertisements.
However Melissa doesn’t seem to like that idea. "It’s just crazy to me because I think I look like Melissa Molinaro," she told E! More recenlty, she tweeted, “Were (sic) still talking about this.” She claims that the ad began to run five months ago and that “some people have too much time on (their) hands.”
