Apollo Nido is working on a way to soften the blow he’s going to receive in court when he appears for sentencing in his fraud case.
The “Real Housewives of Atlanta” husband is just hours from finding out his fate because he is set to appear before a judge. When Sister 2 Sister spoke with Apollo earlier this year, Apollo told us that he doesn’t think he’ll get a very lengthy sentence–probably just a few months.
Now, it seems that Apollo’s trying to hedge his bets! According to RadarOnline.com, he’s asking Atlanta district court to change his status from Criminal History Category V to Criminal History Category IV.
Apollo currently faces up to 30 years in prison on charges of conspiracy to commit fraud. Changing his criminal history category would reduce the maximum sentence that he could receive. He’s been to prison before, but his attorneys believe the charges responsible for his first stay in lockup aren’t serious enough to warrant a category 5 classification.
“A criminal history category of V substantially overstates the seriousness of Mr. Nida’s criminal past, thus warranting a departure from the Guidelines range,” Apollo’s attorney said in a statement issued on Thursday.
The legal rep continued, “Mr. Nida’s lengthy but early small-time criminal history is simply not in the same league as the ‘violent offenders, drug kingpins and perpetrators of far more serious offenses’ that Criminal History Category V was designed to address.”
It’s not clear whether the court will approve his request at this time.
